A busker has pleaded not guilty to allegedly raping an intellectually disabled woman, whom he found in a park and then took to his home, when she was heavily intoxicated, passed out and unable to consent. Wallace Nya Quoibia, 54, of Campbell, appeared in the ACT Magistrates Court on Friday. He pleaded not guilty to a charge of having sex without consent. The man had already been denied bail in December. Magistrate Robert Cook adjourned the case to March 1 for pre-trial mention at the ACT Magistrates Court. Legal Aid lawyer Stephanie MacGougan argued on behalf of Mr. Quobia. In court documents, police say the alleged victim of Mr Quoibia went to Mooseheads in Civic on December 4, 2021. They say the woman had previously consumed a number of alcoholic beverages and recalls sitting down next to a fireplace while drinking more in the nightclub. “[The woman] has no memory of the evening,” the police documents say. “The next thing she remembers is waking up briefly in bed with a man on top of her having sex.” Police documents say ‘the sex was not consensual’ as the woman was asleep and passed out shortly after waking up.Police allege the man was Mr Quoibia, who lives in Ainslie Village in Campbell. According to investigators, he then introduced himself to the woman as Wallace,” said things that made [the woman] uncomfortable” and told her that he had found her, passed out, in Glebe Park. “He said several times that he couldn’t leave her there,” police allege.
